Terms of Use

These terms apply to all use of the Site, including browsing, sending inquiries, subscribing to our newsletter, and registering as a member.

Sales of works are governed by the conditions in our Legal Notice (Specified Commercial Transactions Act) and by the conditions we give you for each transaction. Where those conditions differ from these terms, they prevail.

Membership registration is complete when you send your name and email address through the registration page of the Site and then set a password from the email you receive. There is no charge for registration.

Please enter your registration details accurately. You are responsible for managing your password. Do not disclose it to anyone else or allow anyone else to use it.

If your registration details are untrue, or if you act in breach of these terms, we may suspend your membership or cancel your registration.

If you wish to withdraw from membership, please contact us at the contact point in "12. Contact". We will delete your registration information, except for information we are required by law to retain.

We announce the details of member services (such as information on member-only works, access to prices, and purchase requests) on the Site.

Where the images of works, photographs, text, and other content on the Site are protected by copyright or other rights, those rights belong to the artists, other rights holders, or us. Except for reproduction for private use, quotation, or other uses permitted by law, you may not reproduce, republish, modify, or distribute such protected content without the permission of the rights holder.

When using the Site, you must not:

• Act in violation of the law or public order and morals
• Infringe the copyright, portrait rights, privacy, or other rights or interests of us, the artists, or any third party
• Interfere with the operation of the Site (for example, unauthorized access, placing an excessive load on the Site, or large-scale automated collection of its content)
• Impersonate another person, or send inquiries or applications with false information
• Engage in conduct similar to any of the above

We strive to keep the content of the Site accurate, but we will confirm details such as a work's condition, dimensions, and provenance when you inquire. Every work presented is unique, so a work shown on the Site may already have been sold.

We may change the content of the Site, or temporarily suspend it for maintenance, to respond to technical problems, or for similar reasons.

We are not liable for any loss you suffer in connection with your use of the Site (other than the purchase of works), except where the loss results from our intentional act or negligence. Our liability in connection with the purchase of works is governed by law and by the conditions referred to in "2. Purchasing works".

The content of external websites linked from the Site is provided under the responsibility of their respective operators.

Personal information collected through the Site is handled in accordance with our Privacy Policy.

We may change these terms in response to changes in the law, changes to the Site, or for similar reasons. Before any change takes effect, we will announce on the Site the revised terms and the date on which the change takes effect.

These terms are governed by the laws of Japan. However, if you are a consumer living outside Japan, this does not deprive you of the protection of any mandatory consumer-protection provisions of the law of your country of residence that cannot be excluded by agreement. Depending on the amount in dispute, the Tokyo Summary Court or the Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Site. This jurisdiction clause does not apply to disputes with consumers living outside Japan, who may also bring proceedings in the courts of their country of residence.
